About Licensing
All images licensed from this site are licensed under the conditions of the Licensing Agreement, stated below: 1. Notice of Terms You should read the content of this License Agreement that contains the terms by which you may download and use the photographic images that are posted on this web site (“Content”), or purchase prints of any such image. 2. Usage Rights The usage rights you are purchasing are determined by the selection you make from our “Usage Rights” page on this site. You may use the specific image or images selected solely for the purposes, the time period, and within the country, selected and paid for, and for no other purpose, time, or place. You acquire no rights of ownership or copyright, or any other usage rights to any Content of this site. 3. Usage Fee The license fees we charge for the usage, period of use and territory you have selected, are set forth in our “Pricing” page. Payment of the appropriate licensing fee is required before you may download any Content or before you may use any such Content for any purpose. Payment is to be made by credit card as set forth in our “Method of Payment” page. 4. Extension of License If you wish to renew or extend any license we have granted to you, you must enter into a new License Agreement with us, indicating that it is an extension or renewal of prior licensed rights. 5. Method of Delivery Once you have selected and paid for rights to use Content, you must select how you wish us to deliver the Content to you. We presently offer the following methods:

You agree to pay to us a liquidated damage amount equal to triple the license fee, which you agree is a reasonable amount, for each time such credit is missing or improperly given. 7. Limitation of Liability In any event, under no circumstances will our liability exceed the amount of the license fee or print purchase cost that you actually have paid to us. 10. Prohibited Acts You agree not to use any Content for any defamation, pornographic, or illegal use, or to alter or change, or add to, any Content so as to make any use misleading or deceptive. 11. Indemnification You agree to and shall indemnify and hold us, our agents, and all those acting on our behalf, harmless, including reasonable attorneys fees and expenses, from any and all unauthorized use of any Content which you use or permit others to use. 12. No Oral Modification The terms of this agreement may not be modified or waived unless we agree to such modification or waiver in writing in each instance. 13. Prevailing Law This web site is situated within the State of New York. Any downloading will be done from, and any print order fulfilled in, the State of New York. Accordingly, it is agreed that the laws of the State of New York shall govern this License Agreement and any disputes that may arise under it. Any action brought under the Agreement shall be in the Federal or State Courts of New York The losing party in any such action shall pay the reasonable legal fees and costs of the prevailing party. 14. Entire Contracts You acknowledge that you have read this License Agreement, understand its terms, agree to such terms, and that it is the complete statement of our agreement with you, superceding any prior oral or written agreement you may have had with us relating to its subject matter.
